These Terms of Application (“Terms of Application”) apply when you submit a request for business financing, prequalification, or related information through the Byzfunder website, portal, or any Byzfunder-branded application or service (collectively, the “Application”).
By clicking “See My Options,” “Continue,” “Submit,” or any similar action indicating your intent to proceed, you acknowledge that you have read, understand, and agree to these Terms of Application, as well as Byzfunder’s Terms of Use, Privacy Policy, Credit Authorization, and E-Sign Disclosure, all of which are incorporated by reference.
The Application is intended to allow ByzFunder NY LLC (“Byzfunder,” “we,” “us,” or “our”) to evaluate your business for potential financing options, including but not limited to merchant cash advances, term loans, or other working capital products.
Submitting an Application does not guarantee approval, funding, or specific terms.
By submitting an Application, you represent and warrant that:
Providing false, misleading, or incomplete information may result in denial, delay, or withdrawal of any offer.
You authorize Byzfunder, and its service providers, agents, and partners, to obtain and review information about you and your business as necessary to evaluate your Application, including but not limited to:

By submitting an Application, you authorize Byzfunder to contact you regarding your Application and related financing inquiries using any contact information you provide, including by:
These communications may be delivered using automated technology. Message and data rates may apply. Consent to receive such communications is required to process your Application.
Marketing communications, if any, are subject to separate, optional consent.
You consent to receive all communications, disclosures, agreements, and notices related to your Application electronically, including via email, text message, or through an online portal.
You agree that electronic records and signatures satisfy any legal requirement that such documents be provided in writing.
Hardware and software requirements, as well as your right to withdraw consent, are described in the E-Sign Disclosure, which is incorporated by reference.
Submitting an Application is free and creates no obligation to accept any offer.
Any prequalification, estimate, or indication of eligibility is non-binding and subject to verification, underwriting review, and final approval.
If you do not qualify for financing directly through Byzfunder, you authorize Byzfunder, where applicable, to consider your Application for alternative financing options, which may include reviewing your information internally or in connection with affiliated or approved funding sources, subject to applicable law and your Privacy Policy rights.
Byzfunder reserves the right, in its sole discretion, to suspend, deny, or terminate your Application at any time for any reason, including incomplete information, verification issues, or compliance concerns.
If you withdraw consent to receive electronic communications, your Application will be terminated.
Byzfunder does not provide legal, tax, accounting, or financial advice. Any information provided during the Application process is for general informational purposes only.
You are responsible for evaluating whether any financing product is appropriate for your business.
These Terms of Application supplement, and do not replace, Byzfunder’s Terms of Use. In the event of a conflict, these Terms of Application control with respect to Application-related matters.
