This Electronic Disclosure and Consent (“E-Sign Disclosure”) describes your rights and obligations when receiving disclosures, agreements, notices, and other communications from ByzFunder NY LLC (“Byzfunder,” “we,” “us,” or “our”) electronically.

By submitting an application, clicking “See My Options,” “Continue,” “Submit,” or otherwise indicating your agreement, you consent to receive disclosures and communications electronically as described below.

1. Scope of Electronic Communications

You agree that Byzfunder may provide you with all disclosures, agreements, notices, documents, and communications related to your business financing inquiry or application electronically, including but not limited to:

• Terms of Application
• Credit Authorization
• Financing agreements and amendments
• Disclosures required by federal or state law
• Notices regarding application status, funding, servicing, renewals, or modifications

Electronic communications may be delivered via:

• Email
• Text message (where permitted by law)
• Online portals or web pages
• Other electronic means made available by Byzfunder

2. Consent to Electronic Signatures

You consent to the use of electronic signatures and acknowledge that:

• Electronic signatures have the same legal effect as handwritten signatures
• You intend to sign and be bound by documents electronically
• Your electronic consent applies to all transactions and communications with Byzfunder related to your application or financing

3. Hardware and Software Requirements

To access and retain electronic records, you must have:

• A computer, smartphone, or tablet with internet access
• A current web browser capable of supporting encryption (e.g., Chrome, Safari, Firefox, Edge)
• A valid email address
• Sufficient storage or printing capability to save or print disclosures
• The ability to view PDF or HTML documents

You are responsible for ensuring that your device and software meet these requirements.

4. Paper Copies

You may request a paper copy of any electronic disclosure or document at no charge by contacting Byzfunder using the contact information below.

Requesting a paper copy does not withdraw your consent to receive electronic communications unless you specifically request withdrawal as described in Section 6.

5. Updating Your Contact Information

You agree to keep your contact information current and accurate, including your email address and phone number.

6. Withdrawing Consent

You may withdraw your consent to receive disclosures electronically at any time by contacting Byzfunder in writing or by email.

Important:
If you withdraw your consent:

• Any pending application may be terminated
• You may no longer be able to apply for or receive financing through Byzfunder electronically
• Previously executed agreements and disclosures will remain valid and enforceable

7. Acknowledgment

By clicking “See My Options,” “Continue,” “Submit,” or a similar action, you acknowledge that:

• You have read and understand this E-Sign Disclosure
• You can access and retain electronic records
• You consent to receive disclosures and communications electronically

8. Governing Documents

This E-Sign Disclosure is incorporated into and supplements Byzfunder’s:

• Terms of Application
• Credit Authorization
• Terms of Use
• Privacy Policy

In the event of a conflict, the Terms of Application govern with respect to application-related matters.
