Credit Authorization

This Credit Authorization (“Authorization”) authorizes ByzFunder NY LLC (“Byzfunder,” “we,” “us,” or “our”) to obtain and review information about you and your business in connection with your request for business financing, prequalification, renewal, or related services (the “Application”).

By submitting an Application or clicking “See My Options,” “Continue,” “Submit,” or a similar action, you acknowledge that you have read, understand, and agree to this Authorization.

1. Authorization to Obtain Credit and Financial Information

You authorize Byzfunder, and its service providers, agents, and permitted partners, to obtain, access, review, and retain information about you and your business as necessary to evaluate, verify, service, or administer your Application and any resulting financing.

This information may include, but is not limited to:

• Consumer credit reports and credit-related information
• Business credit reports and trade data
• Bank account information, transaction history, balances, and cash flow data
• Public records, including business registration, ownership, and lien data
• Identity verification and fraud prevention data
• Other information obtained from credit bureaus, financial institutions, data aggregators, or third-party service providers

2. Purpose of Credit and Information Review

You understand and agree that Byzfunder may obtain and use the information described above for purposes that include, but are not limited to:

• Evaluating your eligibility for business financing or prequalification
• Verifying information provided in your Application
• Making underwriting, pricing, structuring, renewal, or servicing decisions
• Monitoring account performance, compliance, or risk
• Preventing fraud, identity theft, or unauthorized activity
• Servicing, modifying, or renewing an existing financing arrangement

3. Ongoing Authorization

This Authorization remains effective:

• For the duration of your Application review
• During any active financing relationship with Byzfunder
• In connection with renewals, modifications, or additional funding requests

You acknowledge that Byzfunder may obtain updated or refreshed information from time to time as permitted by law.

4. Soft and Hard Credit Inquiries

You understand that credit inquiries obtained under this Authorization may include soft inquiries and, where applicable and permitted by law, hard inquiries.
The type of inquiry used may vary depending on the stage of your Application or the nature of the financing requested.

5. Information Sharing

You authorize Byzfunder to share information obtained pursuant to this Authorization with:

• Its affiliates
• Service providers performing functions on Byzfunder’s behalf
• Banks, capital providers, or funding partners involved in evaluating or servicing your financing
• Regulators, auditors, or compliance parties as required by law

All such sharing is subject to Byzfunder’s Privacy Policy.

6. Your Rights

You understand that:

• You may request information regarding the consumer reporting agencies used by Byzfunder, if applicable
• You may have rights under applicable federal or state law to dispute inaccurate information
• You may withdraw this Authorization by contacting Byzfunder; however, withdrawal will result in the termination of your Application and may prevent Byzfunder from offering or servicing financing

7. No Obligation

Granting this Authorization does not obligate you to accept any financing offer, nor does it guarantee approval or funding.

8. Governing Documents

This Authorization supplements, and is incorporated into, ByzfFunder’s:

• Terms of Application
• Terms of Use
• E-Sign Disclosure
• Privacy Policy

In the event of a conflict, the Terms of Application govern with respect to Application-related matters.
